We represent Cape Windlass, a voluntary association not for gain, with its purpose to protect and promote the natural and built environment of the Southern Cape Coast and adjacent interior. Cape Windlass has been involved with legal “battles” with the Lagoonbay company for the past 8 or more years – opposing the development of a big lifestyle golf estate between the N2 and the ocean and adjacent to the Maalgate River (about 12 kilometres from George). And a few years ago Cape Windlass was a party to a conclusive Constitutional Court judgement against the Lagoonbay company in this regard. Almost immediately after the Constitutional Court’s ruling against the Lagoonbay company about their proposed lifestyle golf estate, they (i.e. the Lagoonbay company) applied with the National Department of Agriculture for an agri/residential estate of some 200 “erven” of about 2 hectares each on the same farms. We suspect that the sub-divisional approval by the National Minister of Agriculture of the Lagoonbay agri/residential development in this rural farming area of the George district was illegally granted; for instance, the approval was granted without any notifications, public participation or assessments. We therefore decided to file a review application against the Minister in the Cape High Court a few days ago – see the papers attached.

The principals behind the Lagoonbay project are Mr Thys Roux (from Pretoria) and his son Dr Werner Roux (formerly from Fancourt in George and presently from Stellenbosch/Cape Town). There are a number of “oddities” about the Roux’s and their dealings at Lagoonbay and elsewhere. For instance, we learnt that the Roux’s have a relationship with Mr Roux Shabangu; and that recently the Roux’s were given government house building projects in Limpopo Province of a few billion Rand. Furthermore, RMB is involved in the Lagoonbay project for a few hundred million Rand. During the past few years some committee members of Cape Windlass have been subjected to a number of serious incidents, and the authorities were never willing to prosecute; e.g. a few arson attacks on our houses, specific tampering with the wheel nuts of one of our cars, threats.  

We believe that some investigative journalism will be required; and that this will unearth other incidents/stories of what these parties (i.e. politicians, officials, developers, banks, consultants, attorneys and others) have been and still are up to.
